Following your registration as a Mentor or Mentee in the Mentoring Center the following terms and conditions apply:

By using the pages on this website, you agree to abide by these Terms and Conditions. If you do not agree to these terms of use, please do not use the mycareerdecision.com website. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of this website subsequent to the posting of changes to these terms will signify your acceptance of these changes.

LIMITATION OF LIABILITY

Under no circumstances, including, but not limited to, negligence, shall we be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use, the mycareerdecision.com website, even if we have been advised of the possibility of such damages. In no event shall our total liability to you for all damages, losses and causes of action, whether in contract, tort (including, but not limited to, negligence) or otherwise, exceed the amount paid by you, if any, for accessing this site. MyCareerDecision.com does not guarantee that all members (e-mentors and/or mentees) will actively be using the website.

INDEMNIFICATION

You agree to defend, indemnify and hold mycareerdecision.com harmless from and against any and all third-party claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the site and which are caused by your violation of or failure to comply with any applicable federal, state or local law or regulation or any published policy or rule of mycareerdecision.com, except to the extent caused by mycareerdecision.

GENERAL PROVISIONS

These Terms and Conditions will be governed and be interpreted pursuant to the laws of the State of Louisiana. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions or your use of this website shall be filed only in the federal courts located in Louisiana. If any part of these Terms and Conditions is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Possible evidence of use of this site for illegal purposes will be provided to law enforcement authorities. This is the entire agreement between the parties relating to the use of this website.

MyCareerDecision.com can revise these Terms and Conditions at any time by updating this posting.

MyCareerDecision.com (the “Service”) is an online service for high school and college aged youth. Adults (mentors) must be at least 21 years old.  Youths (mentees) must be at least 13 years of age. MyCareerDecision.com is owned and operated by MyCareerDecision,L.L.C whose address is P.O. Box 872864, New Orleans, La, 70187 USA.

This is a legal agreement (“Agreement”) between you and mycareerdecision. Please read the Agreement carefully before registering for the mycareerdecision.com Service. By registering for the mycareerdecision.com Service, you become a member of the Service (a “Member”), and you agree to be bound by the terms and conditions of this Agreement (the “Standards”) for as long as you continue to be a Member. As used in the agreement the terms “we”, “us” and “our” refer to mycareerdecision.com.

We tolerate only mutual respect.

We welcome people of all races, religions, genders, national origins and points of view. We do not tolerate expressions of bigotry, hatred, harassment or abuse, nor will we tolerate threats of harm to anyone.

Because we encourage discussion and exchange of career development and management topics only, we do not allow threatening, defamatory, abusive or tasteless statements. For the same reasons, we do not allow sexually explicit material in conversations. In addition, we do not support, suggest or encourage interaction between Members for improper or illegal purposes. We do not allow Members to give personal identifying information or passwords to any other Members.

We allow only legal actions.

You may not use the Service to distribute unauthorized copies of copyrighted material, including photos, artwork, text, recordings, designs or computer programs. In addition, we do not allow the trading or swapping of images that are sexually explicit, obscene or vulgar.

All information the member is told about another member is confidential. Sharing that information with others may be a violation of the law, with the exceptions of reports of physical, sexual, emotional abuse and other life-threatening situations.

We reserve the right to release information to the proper authorities, because of a violation of our standards or because of unlawful acts, if the information is subpoenaed, and if we deem it necessary and/or appropriate.

We cannot guarantee the content of comments that you will receive while you are online. Other people’s comments may be offensive, harmful or inaccurate.

MyCareerDecision.com claims no responsibility for users’ remarks.

We do not allow unauthorized commercial actions.

We encourage communication between our members, but posting or transmitting of unauthorized or unsolicited advertising, promotional materials, or any other forms of solicitation to other members of mycareerdecision.com, except in those areas that may be designated for such a purpose, is not allowed.

For the protection of the teens that use the Service, communications via this Service are monitored and no member (youth or mentor) should assume a right to privacy.

You will uphold our Standards.

THE SERVICE DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SERVICE AND NEITHER ADOPTS NOR ENDORSES NOR IS RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, OR STATEMENT MADE BY PARTIES OTHER THAN THE SERVICE.

WARNING – PLEASE READ THIS: It is possible that other members or Members (including unauthorized Members, or “hackers”) may post or transmit offensive or obscene materials on the Service and that you may be involuntarily exposed to such offensive and obscene materials. It also is remotely possible for others to obtain personal information about you due to your use of the Service, and that the recipient may use such information to harass or injure you. The Service is not responsible for the use of any personal information that you disclose on the Service. Please carefully select the type of information that you post on the Service or release to others.

THE SERVICE SHALL HAVE THE RIGHT TO REMOVE ANY MATERIAL POSTED IN THE PUBLIC AREAS OF THE SERVICE THAT IN ITS SOLE OPINION VIOLATES, OR IS ALLEGED TO VIOLATE, THE LAW OR THIS AGREEMENT. NOTWITHSTANDING THIS RIGHT OF THE SERVICE, YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST IN THE PUBLIC AREAS OF THE SERVICE AND IN YOUR PRIVATE E-MAIL MESSAGES.

PROPRIETARY RIGHTS: The Service contains information that is proprietary to Us and Our Members. The Service owns and retains other proprietary rights in the Service. The Service contains the copyrighted material and trademarks of the Service. We invoke full copyright protection over these materials.

THE SERVICE SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THIS SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. THE SERVICE DISCLAIMS LIABILITY FOR, AND NO WARRANTY IS MADE WITH RESPECT TO, CONNECTIVITY AND AVAILABILITY.

TERMINATION

The terms are effective until terminated by either party. You may terminate these terms at any time by discontinuing use of icouldbe.org websites and destroying all Materials obtained from any and all such websites and all related documentation and all copies and installations thereof, whether made under these terms and conditions or otherwise. Your access to mycareerdecision.com may be terminated immediately without notice from us if in our sole discretion you fail to comply with any term or provision of these terms. Upon termination, you must cease use of the mycareerdecision.com website and destroy all Materials obtained from such site and all copies thereof, whether made under these terms and conditions or otherwise.
